Terms of Service

The rules that apply when you access or use the Edytro AI image editing service.

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and the operator of Edytro (“Edytro,” “we,” “us,” or “our”). They govern your access to edytro.com, our AI image editing tools, accounts, APIs, support features, paid credits, subscriptions, and related services (collectively, the “Service”).

By accessing or using the Service, creating an account, or purchasing credits or a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization.

2. Eligibility and Accounts

You must be legally able to enter into a binding agreement to use the Service. The Service is not directed to children under 13; if a higher minimum age applies where you live, you must meet that age requirement.

You may need an account to save work, access credits, manage a subscription, use an API key, or contact support. You agree to provide accurate information, keep your login credentials confidential, and promptly notify us at support@edytro.com of unauthorized access. You are responsible for activity under your account, except to the extent that applicable law provides otherwise.

3. The Service and AI Features

Edytro provides browser-based tools that may let you upload an image, describe an edit, select an available AI model or option, generate or edit an image, download a result, and manage related projects or usage. Features, models, output formats, limits, and availability may change over time.

AI systems can produce inaccurate, unexpected, biased, incomplete, or similar results. Results may not be unique and may not be suitable for your intended use. You must review every result before relying on it, publishing it, selling it, or using it in a consequential setting. The Service is not a substitute for professional legal, medical, financial, safety, or other expert advice.

We do not guarantee that the Service or any generated result will be uninterrupted, secure, error-free, available in every location, or fit for a particular purpose. We may limit, suspend, or discontinue a feature, model, or part of the Service when reasonably necessary for maintenance, security, legal compliance, provider changes, or business reasons.

4. Your Content

“Your Content” means prompts, images, files, text, instructions, and other material that you submit to or create through the Service. You retain your ownership rights in Your Content.

You grant Edytro a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, process, modify as technically necessary, display to you, and otherwise use Your Content only as reasonably necessary to provide, secure, troubleshoot, support, and improve the Service, or as described in our Privacy Policy. This license ends when Your Content is deleted, except for residual copies in backups or records that must be retained by law or for legitimate security and dispute-resolution purposes.

You represent and warrant that:

  • You own Your Content or have all rights, permissions, licenses, and consents needed for Edytro and its providers to process it.
  • Your Content and your use of the Service do not violate applicable law, another person’s privacy, publicity, copyright, trademark, patent, trade-secret, or other rights.
  • You will not upload highly sensitive or regulated information unless you have a lawful reason and have assessed the risks of sending it to the Service and its providers.

Edytro does not claim ownership of Your Content merely because you use the Service. However, you are responsible for keeping your own backups; the Service is not a backup or archival system.

5. Generated Results and Third-Party Models

To the extent permitted by applicable law and subject to third-party rights, you may use images generated for you through the Service for your personal or commercial projects. This does not guarantee that a result is protectable by copyright, exclusive to you, free of third-party claims, or permitted for every commercial use.

Some features rely on third-party AI models, APIs, storage, payment processors, authentication providers, or other services. Their terms, usage limits, licenses, and privacy policies may apply in addition to these Terms. Edytro is not responsible for a third party’s independent service, content, or policy, except as required by law.

6. Acceptable Use

You may use the Service only lawfully and in accordance with these Terms. You must not:

  • Infringe, misappropriate, or violate another person’s rights, or upload an image of a person without any consent required by law.
  • Create or distribute child sexual abuse material, sexual exploitation, non-consensual intimate imagery, credible threats, targeted harassment, or content that facilitates serious harm.
  • Use the Service for fraud, impersonation, unlawful deception, phishing, malware, spam, or other abusive activity.
  • Generate or distribute content intended to manipulate a person in a high-impact decision, or use generated content as if it were verified evidence when it is not.
  • Upload content that violates applicable export controls, sanctions, privacy laws, or other regulations.
  • Attempt to bypass credits, rate limits, access controls, safety measures, payment requirements, or account restrictions.
  • Reverse engineer, decompile, scrape, overload, probe, or interfere with the Service or its underlying systems, except where a restriction cannot lawfully be enforced.
  • Share, sell, rent, or transfer your account or API key, or resell the Service without our written permission.
  • Use the Service to build or train a competing service, model, or dataset in a way that violates these Terms or the rights of a provider.

We may remove content, refuse a request, restrict features, suspend an account, revoke credits, or terminate access when we reasonably believe these Terms, applicable law, or the safety of the Service has been violated. Where appropriate, we will provide notice and an opportunity to appeal or correct the issue.

7. Credits, Plans, and Subscriptions

Some features use credits, plans, one-time credit packs, free trials, or recurring subscriptions. The price, credit amount, billing interval, expiration rules, included features, and other commercial terms shown at checkout or in the applicable plan description are part of these Terms.

  • Credits are a limited, non-transferable license to use eligible features and are not cash, a bank balance, or property that can be redeemed for money.
  • Credits may be consumed when a generation or other chargeable task is submitted. A failed or interrupted task may be subject to the adjustment rules shown in the Service.
  • Subscription credits, one-time packs, promotional credits, and trial credits may have different expiration or consumption rules. The rules presented when you receive or purchase them control.
  • We may change prices, plans, credit costs, or included features prospectively. Changes will not reduce rights that cannot legally be changed retroactively.

When you purchase a paid plan or subscription, you authorize the selected payment provider to charge the displayed amount and any applicable taxes. A recurring subscription renews for the displayed interval until canceled. You can cancel through the account or billing controls made available by the Service; unless required otherwise by law or stated at checkout, cancellation takes effect at the end of the current paid period.

Refunds, credits for failed tasks, and cancellation rights are handled according to the terms shown at checkout, any applicable refund policy, the payment provider’s rules, and mandatory consumer law. For a billing issue, contact support@edytro.com with your order or subscription details.

8. API Keys

If the Service provides API keys, you are responsible for keeping them secret, limiting their use to authorized applications, and rotating or revoking them if exposed. Requests made with your key may count against your credits, limits, or account. Do not place a private API key in a public repository, client-side application, or shared environment.

9. Intellectual Property

The Service, including its software, design, branding, text, interfaces, documentation, and underlying technology, is owned by Edytro or its licensors and is protected by intellectual-property and other laws. Except for the rights expressly granted in these Terms, we grant you no license to copy, modify, distribute, sell, lease, or create derivative works from the Service or our marks.

If you send suggestions, ideas, or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use and incorporate that feedback without compensation, provided we do not identify you publicly without permission.

10. Third-Party Services and Links

The Service may contain links to third-party websites or rely on third-party services. We do not control and are not responsible for third-party content, availability, security, terms, or privacy practices. Your dealings with a third party are between you and that third party.

11. Suspension and Termination

You may stop using the Service and request account closure by contacting support@edytro.com or using an available account control. We may suspend or terminate access for a breach of these Terms, non-payment, fraud, security risk, legal requirement, prolonged inactivity, or other legitimate operational reason.

After termination, your right to use the Service ends. Sections that by their nature should survive termination—including provisions about Your Content, payments, intellectual property, disclaimers, liability, indemnity, disputes, and interpretation—will survive. Unless required by law, unused credits and access to stored content may be forfeited on termination for cause.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL GENERATED RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, PRODUCE A PARTICULAR RESULT, OR REMAIN AVAILABLE.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded in your jurisdiction.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDYTRO AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EDYTRO FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Edytro and its owners, affiliates, licensors, service providers, and personnel from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your Content, your misuse of the Service, your violation of these Terms, or your violation of another person’s rights or applicable law.

15. Governing Law and Disputes

These Terms are governed by the laws applicable to the jurisdiction where the operator of Edytro is established, without regard to conflict-of-law rules, except that mandatory consumer-protection laws in your place of residence continue to apply. Courts with jurisdiction over that operator will have non-exclusive jurisdiction, unless applicable law gives you the right to bring a claim elsewhere.

Before filing a formal claim, please contact support@edytro.com and give us a reasonable opportunity to resolve the issue. Nothing in this section limits a non-waivable right to use a regulator, small-claims process, or other forum available under applicable law.

16. Changes to These Terms

We may update these Terms to reflect changes to the Service, law, providers, or business operations. We will post the updated version on this page and change the “Last updated” date. If a change is material, we will provide additional notice where required. Your continued use of the Service after the effective date means you accept the updated Terms.

17. General Terms

If any provision is found unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be interpreted as closely as the law allows. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any terms shown at checkout or for a specific feature, are the entire agreement about the Service and replace prior agreements about the same subject.
